Charter

AN ACT .

TO INCORPORATE THE VILLAGE OF WILLIAMSVILLE.

The People of the State of New York, represented in Senate and assembly, do enact as follows:

  Section 1.  The territory within the following limits shall constitute the Village of Williamsville:  Commencing at the southeast corner of lot number one in the twelfth township and seventh range of the Holland Land Company's survey; thence north eighty-six degrees west, seventy chains forty links to a post in David Long's land; thence north three and one-half degrees east, thirty-six chains eighty-seven links to a post; thence south eighty-six degrees east, sixteen chains thirty six links, intersecting the west line of lot number one in the north bounds of Bear St; thence north four degrees east , nineteen chains thirty links to a stone, being the northwest corner of lot number one; thence south eight-six degrees east, twenty-seven links to a post; thence north two and three-fourths degrees east, elen chains twenty-eight links to a post; thence south eighty-six degrees east, eight chains seventy-one links to a post; thence south two and three-fourths degrees west, eleven chains twenty-five links, intersecting the north line of lot number one; thence south eighty six degrees east, twenty-eight chains four links to a stone wall; thence south fifteen and one-half degrees east,  fourteen chains twelve links to the south bounds of Main street; thence south eighty degrees west, one chain fifty-five links to a post; thence south two and three-fourths degrees west, eleven chains five links to a post; thence south eighty degrees west, thirteen chains eighty links to the east bounds of Garrison street; thence south four degrees west, twenty seven chains ninety five links to the place of beginning.

   2. The inhabitants of said village shall be a corporation by the name of the Village of Williamsville, and may sue and be sued, complain and defend in any courts; may make and use a common seal and alter it at their pleasure, and receive by gift, grant, devise, bequest or purchase, and hold and convey such real estate and personal property as the purposes of the corporation may require, provided that no purchase of any real estate and no public buildings or reservoirs be erected, made or in any manner disposed of without the consent of the freeholders who are inhabitants of said village, or a majority of such persons voting at any legal meeting.

  3.  The officers of said village shall be denominated village officers and shall be elected by ballot by the electors of said village, and shall hold their offices respectively as hereinafter provided, and until their successors shall be duly qualified.  There shall be five trustees, one of whom shall be selected by said board of trustees to be president of the board, and shall preside at all corporation meetings; one clerk, one treasurer, one collector, one assessor and one street commissioner, who shall hold their respective offices one year; and all other officers hereinafter named in this act shall be appointed annually by the board of trustees, and may be removed by the board of trustees for sufficient cause shown; the party shall have the right to be heard in his defense.

  4.  An election of the village officers, to be called the village election, shall be held annually on the second Tuesday of March, at such place in said village as shall be appointed by the board of trustees, of which place so appointed by said trustees for holding the election six days notice shall be given by posting notices in three public places in said village, otherwise to be held in the engine house of said village on the second Tuesday of March, each and every year.

  5.  No person shall be eligible to any office of said village unless he shall  at the time be a resident and elector of said village, and whenever any officer of said village shall cease to be a resident thereof, his office shall thereby become vacant.

  6.  Every inhabitant actually residing in said village, and who shall have been an actual resident of said village for ten days next prior to the time of offering his vote, and who shall at the time of offering his vote be qualified to vote for member of assembly, shall be entitled to vote at any village election for village officers.
